How do lawyers get paid?
Attorneys get paid many different ways, depending on the practice area. But let’s explain how our Florida law firm handles cases. If you get in an accident and you are afraid you cannot afford to hire a lawyer, think again. We are proud to say that we never get paid unless you do in any accident case. And no matter what, we ALWAYS off a free initial consultation in every one of our practice areas. We offer these free consultations to all our potential clients because at the LaBovick Law Group we truly care about your best interest. If you don’t have a case or don’t feel comfortable proceeding forward, you haven’t lost anything besides a few minutes. We never shuffle clients through the system like they are just a number. We treat each client and his/her case uniquely.
But what happens after that initial consultation? Will there be fees or out-of-pocket costs? This truly depends on the nature of your case, but in most cases, simply, we do NOT get paid unless you get paid. The following list is a breakdown of our main practices and how our attorneys are compensated from each case.
A personal injury case stems from the negligence or unsafe actions of another person or organization. These actions cause bodily injury that can be physical or psychological. Car accidents, truck accidents, pedestrian accidents, bicycle accidents, and slip and fall accidents are just a few things that can fall into the category of a personal injury case.
How we get paid from these cases: Personal injury cases work on a contingency. This means that we ONLY get paid if and when YOU are paid. Once your case is completed your attorney will receive a small percentage of the settlement or court award. If you have an accident case, we will explain all of this in detail for you at the initial consultation.
Maritime cases, also sometimes referred to as admiralty cases, are much like personal injury cases, only the accident happened while on the water. This could include recreational boating accidents, Jet Ski accidents, cruise ship injuries or even dive accidents. If you have been injured on the water, keep in mind that the general way the case is handled might be similar, but the laws on the water are much different than those on land. In most cases, you have much less time to file a claim after you’ve been hurt on the water.
How we get paid from maritime cases: Just like personal injury cases, we only get paid once you get compensated for your injuries, lost wages and medical bills.
Social Security Disability (SSD) Benefits
Applying for SSD benefits can be difficult, and if you are initially turned down it can feel like the end of the line. You should know that almost everyone gets denied by the Social Security Administration on their initial application. At LaBovick Law Group we can walk you through the entire process, from application through approval. If you’ve been denied once or even twice, we will help you set up a hearing and will do everything we can to help you get approved for disability benefits.
How we get paid: We know these circumstances are tough for you, so it’s important to us that you, the client, is fully taken care of first. We will only get compensated in your case after you’ve been approved for benefits. Unlike other legal practices, we will only get paid from any back benefits you are awarded. The percentage we get paid is strictly set by the Social Security Administration, and we get capped at a certain total ensuring you receive the most compensation possible.
Back benefits are the payments you are owed from the time you initially put in your application to when you are actually accepted. This means if you are not eligible for back benefits we do not get paid, no matter what stage in the process you’ve gotten approved. For example, if we handle your case from the initial application process and your case is expedited to an acceptance, we would only get paid if you were found disabled before the initial application. Or on the flip side, if we are with you through the entire process, through denials and a hearing and then help you get accepted for benefits, we would ONLY get paid, even now, if you are eligible for back benefits.
As a veteran, you may be able to receive compensation from the US Department of Veterans Affairs (VA) if you were injured during your service. Unlike SSD benefits, you do not have to be 100% disabled to receive VA benefits. If the VA determines that you are at least 10% disabled you or your family may be able to receive benefits.
How we get paid: We only get paid if you are paid. We are only allowed to help you with your veteran’s benefits if you’ve already been denied on your initial application from the VA. And then, we would only be compensated from a percentage of back benefits you are eligible for and are awarded. Just like the other practice areas… we only get paid if you are paid.
PIP Insurance Claims and Collections
In personal injury protection (PIP) insurance cases, we represent medical providers in cases where they are underpaid or denied payment by the insurance companies for accident patients.
How we get paid: In PIP cases, there are absolutely no upfront, out-of-pocket costs for our medical provider clients, including doctors, surgeons, MRI facilities, medical billing companies, etc. These cases are separated into pre-litigation and litigation cases. This means we send demand letters, etc. to recover the underpaid or unpaid PIP bills. If our company helps you recover your benefits in this stage of the process, we get a small percentage of monies recovered. This is found money for our medical providers that they weren’t expecting to get, and they’ve received that without any aggravation or costs on their part.
If those demand letters are not responded to in a timely manner by the insurance companies and benefits cannot be recovered, then LaBovick Law Group’s PIP Suit Litigation team takes over, and we’ll bring these cases of unpaid or underpaid PIP bills to court. Our firm only gets paid for attorney fees and court costs in these matters, and these fees and costs are paid to us by the insurance carriers, so we ensure that our medical provider clients do not incur any out of pocket costs. We would then get a small percentage of benefits found for all the pre-litigation work handled, as mentioned above. At the end of the day, medical providers still walk out of the situation with what feels like free money!
